Terms of Purchase & Use of The Growth Academy Lead System

These Terms govern your purchase, access, and use of leads, lead packs, campaigns, services, and systems provided by The Growth Academy Limited.
By purchasing leads, paying an invoice, accessing the client portal, or receiving leads, you agree to all sections contained on this page.

These terms are designed to protect the integrity of our lead system, ensure fair and consistent practices for all clients, and maintain the quality and exclusivity of our service.

1. Lead Return Policy

We use high-intent channels and advanced filters to deliver exclusive, qualified leads. But no system is perfect, a small number of invalid leads will slip through.

That’s why we have a clear, fair return policy. When a lead is genuinely invalid, we’ll credit you. Here’s how it works.

What Counts As A Valid Lead

A Valid Lead:

  • Has a working phone number
  • Has a real name that matches the number
  • Is not a duplicate from us within the last 30 days
  • Shows intent to speak with a financial adviser or broker

Note: A lead is still valid if they don’t answer, change their mind, or go cold. You’re buying access to qualified prospects, not guaranteed clients.

Returns approved if:

We’ll credit the full cost of a lead if any of the following apply:

  • Invalid phone number (disconnected, not recognised, won’t accept calls)
  • Goes to voicemail that doesn’t match the contact’s name
  • Clearly fake (e.g. Mickey Mouse, gibberish)
  • Test submission
  • Duplicate from us (same name, email, and phone within 30 days)

Request must be submitted within 5 days (120 hours) of lead delivery.

Returns not approved if:

Refunds will not be provided in the following situations:

  • The lead doesn’t answer, respond, or follow up
  • They change their mind, ghost, or lose interest
  • They’ve already spoken to another adviser
  • You can’t serve them, or they choose someone else
  • They submitted info elsewhere (not a duplicate unless it’s in our system)
  • You miss the 5-day return window
  • You’re actively doing business with them

Other cases may be reviewed, but if it’s not listed above, don’t assume a refund.

Lead Return Process

If you feel you have received a lead which falls under one of the allowable return reasons and you would like to make a request to return it this can be done from within your account dashboard in the customer portal. This is the only way returns can be submitted and processed.

Go to Leads on the left hand side menu. Select the Campaign and date the lead in question was received:

Then you can click on the Lead ID and select Return and enter the Return Reason:

This will notify us immediately and we will then review your return request.

Approved lead returns automatically credit your account back with the full cost of the lead type.

Focus on ROI, Not Individual Leads

We price leads based on realistic conversion rates. Not every lead will convert, and that’s already factored into the cost.

What matters is your overall ROI, not whether every lead turns into a client. Our most successful advisers convert:

  • 50–70% of leads into meetings
  • 20%+ into clients
  • With an average 10x return on investment

Here’s what that looks like in practice (based on risk insurance leads):

  • 10 leads @ $100 = $1,000 investment
  • 5–7 meetings booked
  • 2 clients closed
  • $5,500 total API
  • $11,000 commission (at 200%)
  • $10,000 net profit

That’s the real game, and this policy helps keep it fair, sustainable, and profitable for everyone.

2. General Terms

Billing

  • All validated leads are deemed purchased and count toward your purchased lead amount
  • Billing reports are shared on request and can be accessed from the customer portal
  • Lead prices vary by vertical and volume and may change with notice

Your Account

If you wish to cancel your account, we require 72 hours’ notice.

If advisers are waiting for available seats, we reserve the right to discontinue your account if it remains inactive for more than 7 days after fulfilling your previous purchase

Ownership

Leads are owned by you (the Client) once delivered.

However:

All funnels, ads, landing pages, forms, brands, copy, and systems used to generate the leads remain the exclusive intellectual property of The Growth Academy Limited.

You receive access, not ownership, of the system.

Liability & Advice

  • You are solely responsible for compliance and conduct within your industry
  • The Growth Academy Limited accepts no responsibility for any advice you provide to customers or prospects

3. Proprietary System & IP Protection

Proprietary System

You acknowledge that The Growth Academy operates a proprietary lead generation ecosystem, including but not limited to:

  • Landing pages
  • Webforms
  • Funnels
  • Brand assets (lead generation websites)
  • Ad creative and messaging
  • Targeting, filters, and bidding strategy
  • Data structures and lead routing
  • The client portal
  • Backend automation, scripts, and flows

All IP associated with this system is exclusively owned by The Growth Academy Limited.

Non-Replication Clause

You agree that you will not:

  • Copy or replicate any landing page, funnel, form, or website
  • Build competing or derivative brands based on our assets
  • Use our copy, creative, messaging, layouts, or designs
  • Duplicate or reverse-engineer any part of our system
  • Run ads using our creative style or messaging frameworks
  • Use any of our funnels, structures, or processes for your own marketing

This applies whether replication is exact, partial, inspired, or modified.

Breach & Remedies

If you breach this clause:

  • Your account may be terminated immediately
  • Lead access may be paused or revoked
  • A commercial IP breach fee of $10,000 NZD may be applied
  • Continued work may only occur at revised pricing + removal of replicated assets

We reserve the right to request screenshots, access, or proof of removal of any replicated assets.

4. Acceptance of Terms

These Terms apply automatically when:

  • You purchase a lead pack
  • You pay a Xero invoice
  • You access the client portal
  • You receive leads
  • You continue using our system after updates

Payment = acceptance.
Access = acceptance.
Receiving leads = acceptance.

  • We may update these Terms from time to time.
  • If material changes occur, we will notify you via email.
